These are the agreements and policies behind Perchway. We've tried to write them in plain English. Where the law needs precise wording, we've used it, and the summaries at the top of the longer documents point out what matters most.
The documents
- Terms of Service: The main agreement for using Perchway, covering accounts, plans and fees, payments, your content, our software license, and how disputes are handled.
- Privacy Policy: What personal information Perchway collects, why, who we share it with, how long we keep it, and the choices and rights you have.
- Acceptable Use Policy: What can't be sold, posted or done on Perchway, and what happens if someone breaks the rules.
- Seller Terms: Extra terms for freelancers who sell or take payments through Perchway, covering approval, your Stripe and PayPal accounts, fees, payouts, shipping, refunds, disputes and taxes.
- Buyer Terms: Terms for clients who buy from, pay or work with a freelancer through a Perchway shop, invoice or client portal.
- Refunds and Cancellations: How cancelling a Flight or Soar subscription works, when premium templates are refunded, and when buyers get refunds for things bought from freelancers through Perchway.
- Copyright and Trademark Policy: How to report copyright or trademark infringement on Perchway, how to respond to a report, and our repeat infringer policy.
- Data Processing Addendum: How Perchway handles personal information that freelancers keep about their clients, including the commitments privacy laws like GDPR and CCPA ask for.

How they fit together
The Terms of Service are the main agreement for everyone who uses Perchway. Perchway runs in your web browser, so there's no software to install, and the Terms also work as Perchway's software license (what some services call an EULA). The Seller Terms, Buyer Terms, Acceptable Use Policy, Refunds and Cancellations, Copyright and Trademark Policy and Data Processing Addendum add detail for particular situations and are part of the Terms when they apply to you. The Privacy Policy explains what personal information we collect and what we do with it.
The most important points
- Freelancers sell directly to their clients. When a client pays a freelancer through Perchway, the payment goes straight to the freelancer's own Stripe or PayPal account, which pays it out to them. The freelancer makes and delivers the work, ships any physical items themselves, and handles their refunds, card disputes and taxes. Perchway runs the shop, checkout and delivery, but never handles physical items.
- Perchway's fee is 5% of the price of each sale on the Free plan, 4.25% on Flight and 3.5% on Soar, not counting shipping or tax, taken automatically as each payment is made. Stripe's and PayPal's processing fees are separate, and charged to the freelancer by them.
- You own what you put in Perchway. We only use it to run Perchway for you, and we don't sell personal information.
- Automated checks, including AI, ours and those of services like Stripe, PayPal and Cloudflare, help us spot fraud and abuse and review sellers. A person on our team makes the decisions that matter, like declining a shop or closing an account, and you can ask for another look.
- Selling is open to US-based freelancers for now, physical items ship only to US addresses, and sellers are reviewed before their shop can take payments. Clients are refunded when work or an item isn't delivered, arrives damaged or isn't as described, whatever the shop's own refund policy says.
- Disputes with Perchway go to individual arbitration, not class actions, unless you opt out within 30 days. See section 18 of the Terms.
Who we are
Perchway LLC, a Wisconsin limited liability company, runs perchway.com and prch.shop. "Perchway", "we" and "us" in these documents mean Perchway LLC.
