The short version. Perchway is for creative freelancers selling honest work to their clients. Don't use it for anything illegal, harmful, deceptive or infringing, and don't sell things our payment partners Stripe and PayPal don't allow. If you do, we may remove content or close your account.
This policy is part of our Terms of Service and applies to everyone who uses Perchway: Freelancers, their team members, Clients and visitors. Words like "Freelancer", "Client" and "Content" mean what the Terms say they mean.
1. Content you can't post or deliver
Don't upload, publish, send or deliver Content that:
- is illegal where you are or where it's sent, or promotes illegal activity
- infringes anyone's copyright, trademark, privacy, publicity or other rights, including work you don't have permission to sell or deliver (see our Copyright and Trademark Policy)
- sexually exploits or endangers children in any way. We report this to the National Center for Missing & Exploited Children and to law enforcement.
- is sexually explicit, or offers sexual services
- shares someone's intimate images without their consent, or deepfakes or AI-generated images or voices that impersonate a real person without their consent
- threatens, harasses, bullies or encourages harm against anyone, or encourages self-harm
- attacks people based on race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, disability, age or serious illness
- glorifies or supports terrorism or violent extremism
- shares someone's private information without permission, like home addresses, ID numbers or financial details (doxxing)
- is false or misleading in a way that could cause harm, including fake reviews, testimonials or endorsements
- contains malware, phishing pages or anything designed to harm devices or steal information
2. Things you can't sell or offer
Freelancers can't use Perchway to sell, advertise or take payments for:
- anything illegal, or anything that helps someone break the law
- weapons, ammunition, explosives, or parts and instructions for making them
- drugs, drug paraphernalia, controlled substances, or products that claim to treat or cure medical conditions
- tobacco, vaping products, cannabis or CBD
- alcohol
- food, drinks, dietary supplements, cosmetics or skincare, or anything else meant to be eaten, drunk or put on the body
- hazardous materials, like anything flammable, explosive, corrosive, toxic or under pressure, or anything carriers won't accept
- live animals or plants, or products made from protected species
- recalled products, or products that don't meet the safety rules that apply to them, including the rules for children's products
- stolen goods
- gambling, lotteries, sweepstakes or games of chance played for money
- adult content or services
- financial services, investment advice or opportunities, cryptocurrency sales, loans, credit repair or debt relief
- get-rich-quick schemes, multi-level marketing, pyramid schemes or "passive income" programs
- fake engagement: followers, likes, views, reviews or ratings, or accounts on other platforms
- academic dishonesty, such as writing essays, taking tests or doing coursework for students to hand in as their own
- counterfeit or knock-off goods, or other people's work passed off as your own
- personal data, contact lists or leads gathered without people's consent
- services that need a license you don't hold, such as legal, medical or financial services
- anything else Stripe or PayPal doesn't allow. Stripe's list of restricted businesses applies to every payment through Perchway, and PayPal's Acceptable Use Policy to every PayPal payment.
3. How you can't use Perchway
Don't:
- break the law, including consumer protection, tax, privacy, anti-spam and export laws
- defraud anyone, take payment for work or items you don't intend to deliver or ship, or misdescribe what you sell
- launder money, or use Perchway to move money for anyone other than yourself
- pretend to be someone else, or misrepresent who you are or who you work with
- send spam or unwanted marketing through Perchway messages, invoices or emails, or add people as Clients who haven't agreed to work with you
- collect other users' personal information without permission, or use it for anything other than your work together
- try to get into accounts, systems or data that aren't yours, probe or test our security without our written permission, or get around rate limits, access controls or fees
- overload, disrupt or interfere with the Service, or upload anything meant to harm it
- scrape the Service or use bots, except through an API we publish, within its limits
- use Perchway to host files unrelated to your work with Clients, or as general file storage or a content delivery network
- help or encourage anyone else to do any of the above
Found a security problem? Please tell us at [email protected] instead of testing it further. We won't pursue anyone who reports a problem to us in good faith, doesn't access more data than needed to show it, and gives us reasonable time to fix it before telling anyone else.
4. Custom code
Flight and Soar let Freelancers add their own HTML, CSS and embedded content to their shop pages. Everything above applies to it. Also, don't use custom code to:
- take payment any other way, such as with payment buttons, other checkouts, or links to pay outside Perchway for what's in your shop
- ask for card or bank details, passwords or sign-in codes, or imitate Perchway's checkout, sign-in or client portal
- hide, cover or change prices, the Buy button, receipts, or the notices and links Perchway puts on every shop
- track visitors or collect their personal information without the notice and consent the law requires, or sell or share it with data brokers
- send visitors somewhere they didn't choose to go, with pop-ups or automatic redirects
- mine cryptocurrency, load malware, or slow down or break the page
- get around the sandbox, our security or your plan's limits
5. What happens if someone breaks this policy
Depending on how serious it is, we may:
- remove or restrict the Content
- switch off custom code on a shop
- ask you to make changes
- limit features, pause payments or ask Stripe or PayPal to hold them
- suspend or close the account
- report it to Stripe or PayPal, to law enforcement, or to anyone whose rights were affected
We find problems through reports, our own reviews and automated checks, some of which use AI (section 11 of the Terms). A check may hold something until a person looks at it, but a person on our team decides to suspend or close an account. We decide what's appropriate, and we can act without warning when there's a risk of harm or legal liability. If you think we've made a mistake, email [email protected] and we'll take another look.
6. Reporting a problem
To report Content or behavior that breaks this policy, email [email protected] with a link to it or the name of the shop, and what's wrong. For copyright or trademark problems, follow our Copyright and Trademark Policy. If someone is in immediate danger, contact your local emergency services first.
