The short version. When you buy through a Perchway shop, invoice or payment link, you're buying from the freelancer. Your payment goes to them, through Stripe or PayPal, and their business name is on your card statement. Perchway runs the shop, checkout and delivery for them. The freelancer makes and delivers the work, and ships physical items themselves, and their description or your contract with them sets what you get. If something goes wrong, talk to the freelancer first. If that doesn't fix it, contact us, and we'll step in as our refund policy describes.
These Buyer Terms are part of our Terms of Service and apply when you buy from, pay, or work with a Freelancer through a Perchway shop, client portal, invoice or payment link. Words like "Freelancer", "Client" and "Content" mean what the Terms say they mean. "You" means you as a Client.
1. Who you're buying from
- You buy from the Freelancer. The Freelancer is the seller, and your payment goes to them. Perchway provides the shop, checkout, client portal and file delivery the Freelancer uses, and isn't a party to the sale. Perchway never handles physical items.
- The Freelancer makes and delivers the work. They're responsible for what they make, its quality, delivering or shipping it on time, any sales tax or VAT on it, and refunds under their refund policy. Perchway doesn't do the work, and doesn't check Freelancers' qualifications. We do review Freelancers before their shop can take payments.
- What you get is set by the Freelancer's description or your contract. For a product, that's the description in their shop. For custom work, it's the proposal or contract you agreed with the Freelancer, which is between the two of you. These set what's included and what you may do with the work, such as where you can use it and whether you own it. Perchway doesn't take or keep any rights in the work itself.
2. Paying
- Payments are processed by Stripe, into the Freelancer's own Stripe account. Stripe collects your card or bank details, and Perchway never sees or stores the full numbers. Stripe's Privacy Policy covers how Stripe handles them.
- If you pay with PayPal, PayPal processes the payment into the Freelancer's own PayPal account, under your agreement with PayPal. For something that ships, it goes to the address you choose in PayPal. PayPal's Privacy Statement covers how PayPal handles your information.
- Fraud checks. Stripe and PayPal check payments automatically, using machine learning, and may decline one that looks fraudulent. Perchway also uses automated checks, some of which use AI, to spot fraud and abuse, as our Privacy Policy explains. If a genuine payment is declined, try another card or way to pay, or email [email protected].
- Your statement shows the Freelancer's business name.
- Prices, shipping and tax. Prices are in US dollars unless shown otherwise. Shipping, and any sales tax or VAT the Freelancer charges, are shown at checkout before you pay.
- Bank transfers can take a few business days to clear.
- What you've paid counts. Paying through Perchway pays the Freelancer for that purchase or invoice.
- Pay only at Perchway's checkout. Some shops include the Freelancer's own code, or content from other services, like a video or a booking calendar. Perchway's checkout and your client portal never run it, and we never ask for card details anywhere else. If a shop asks you to pay some other way, it isn't a Perchway purchase, so our refund policy doesn't cover it. Please report it to [email protected].
3. Getting what you bought
Files
- If a Freelancer uses pay-to-unlock delivery, you'll see watermarked previews first. The full files unlock automatically once your payment succeeds. For a bank transfer, that can take a few business days.
- Download your files and keep your own copies. Files stay available while the Freelancer's account keeps them, but Perchway doesn't promise to store them forever.
Physical items
- US addresses only, for now. Physical items ship only to addresses in the United States. Give a complete, correct shipping address at checkout. If a parcel goes astray because of an address you gave, the Freelancer doesn't have to replace it.
- The Freelancer ships it, with a carrier they choose, within the time shown on the item, and adds tracking when their carrier provides it. We'll email you when it's on its way.
- Check it when it arrives. If it's damaged or isn't what was described, tell the Freelancer within 7 days, with photos if you can, and keep the packaging until it's sorted out.
- Returns for a change of mind are up to the Freelancer's refund policy. If they take returns, you usually pay to send the item back.
4. Refunds and problems
- Start with the Freelancer. Message them from your client portal, or use the contact details on their shop. Most problems are fixed there, and they can refund you straight away.
- If that doesn't work, email [email protected] with your receipt. Our Refunds and Cancellations page explains when you're owed a refund whatever the Freelancer's policy says, for example when work or an item wasn't delivered, arrived damaged, or isn't what was described. In those cases we can refund you from the Freelancer's Stripe account.
- Before you dispute a charge with your bank, please contact the Freelancer or us. We can usually sort things out faster, and disputing a charge for something you received as described may break this agreement.
5. Perchway's responsibility to you
The Freelancer is responsible for what they sell you. Perchway's part is to run the shop, checkout and delivery, and to step in on refunds as our refund policy describes. Beyond that, the Terms limit Perchway's liability. None of this takes away rights you have under consumer protection laws where you live that can't be limited by contract.
6. Your client portal
- You sign in to a client portal with a one-time code or link sent to your email. Anyone who can get into your email may be able to get into your portal, so keep your email secure.
- The Freelancer can see what you send, sign and pay in the portal, and so can their team members.
- If you sign a proposal or contract in the portal, your electronic signature is legally binding, and we record your name, email address, the time, your IP address and your browser as evidence. Section 10 of the Terms has the details.
- Follow our Acceptable Use Policy in anything you upload or send.
7. Your information
The Freelancer you buy from gets your name, email address and what you bought, and your shipping address for physical items, so they can deliver or ship it. Perchway keeps a record of your purchases to run checkout and delivery, collect our fee, prevent fraud and meet legal obligations. Anything else the Freelancer keeps about you in Perchway, they decide what happens to, and we handle it for them. Our Privacy Policy explains all of this, and how to make a privacy request.
